Terms of Service
These Terms of Service ("Terms") govern your use of the MindFlip mobile and web applications (the "Service") provided by MindFlip ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service (or 16 if you are in the European Economic Area, the United Kingdom, or another jurisdiction where 16 is the minimum digital-consent age). By using the Service, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian.
2. Your Account
To access certain features (leaderboards, friends, daily puzzles, in-app purchases), you must sign in via Google, Apple, or Facebook. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us at support@mindflipgame.app if you suspect unauthorized access.
You may use only one account per person. You may not transfer or sell your account.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or in violation of any applicable law.
- Cheat, exploit bugs, manipulate scores, use bots or automation, or otherwise compromise the integrity of leaderboards, daily puzzles, or shared games.
- Harass, abuse, threaten, or impersonate any person, or post offensive content as a username, avatar, or in shared-game messages.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the limited extent permitted by applicable law.
- Interfere with the Service's operation, including via denial-of-service attacks, excessive automated requests, or attempts to access systems or data you are not authorized to access.
- Resell, sublicense, or commercially exploit the Service or any in-app content without our written permission.
We may remove content, restrict features, or terminate your account if we believe in good faith that you have violated these Terms.
4. In-App Purchases and Subscriptions
4.1 General
The Service offers optional in-app purchases, including:
- Subscriptions (monthly, annual, or lifetime "Full" tier access).
- Consumables such as power-up bundles and credit packs.
- Cosmetic items such as piece styles, sound packs, and music tracks.
Prices are shown in the Service before purchase and may vary by region and platform.
4.2 Subscriptions
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before renewal. You can cancel a subscription through:
- iOS: Settings -- [your name] -- Subscriptions
- Android: Google Play Store -- Menu -- Subscriptions
- Web (Stripe): through the customer portal link in your account settings, or by emailing us
Cancelling a subscription stops future renewals. You retain access for the remainder of the period you have already paid for.
4.3 Refunds
See our Refund Policy for details on how refunds are handled. Refund eligibility depends on the platform you purchased through (App Store, Google Play, or Stripe).
4.4 Consumables and Credits
Power-ups, credits, and other consumable items are non-refundable once used. Credits have no monetary value and cannot be transferred between accounts or converted back to currency. Daily credit-earning is capped at 50 credits per UTC day.
5. Intellectual Property
5.1 Our Content
The Service, including its source code, game design, graphics, sounds, music, and branding, is owned by MindFlip and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial enjoyment.
5.2 Your Content
You retain ownership of usernames, avatars, and shared-game messages you provide ("User Content"). You grant MindFlip a worldwide, royalty-free, non-exclusive license to host, display, and distribute your User Content within the Service for the purpose of operating it (for example, displaying your username on leaderboards or your shared-game message to your friends).
You represent that you have the right to provide your User Content and that it does not infringe any third party's rights.
6. Service Availability
We aim to keep the Service operational at all times but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at our discretion. We will provide reasonable notice for material changes affecting paying subscribers.
7. Termination
You may stop using the Service at any time. You may delete your account from within the app (Settings -- Account -- Delete Account) or by emailing support@mindflipgame.app.
We may suspend or terminate your account if you violate these Terms, engage in fraud or abusive behaviour, or for legitimate operational reasons. We will provide notice where reasonably possible.
Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 11 (Governing Law) survive termination.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. THE ABOVE EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MINDFLIP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $50.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW, AND NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
10. Indemnification
You agree to indemnify and hold harmless MindFlip from any claims, losses, or expenses arising from your violation of these Terms, your User Content, or your misuse of the Service. This obligation does not apply to ordinary, lawful use of the Service.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any disputes arising out of or relating to these Terms or the Service, except that nothing in this section limits your right to bring a small-claims action in your local courts where permitted by applicable consumer-protection law.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. For material changes, we will provide additional notice (for example, an in-app message). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Service and delete your account.
13. Apple App Store Additional Terms
If you obtained the Service through the Apple App Store, you acknowledge:
- These Terms are between you and MindFlip only, not Apple. Apple is not responsible for the Service or its content.
- Your use of the Service must comply with the Apple Media Services Terms.
- Apple has no obligation to provide maintenance or support for the Service.
- If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
